Brazil: Practitioner Navigates 'Complex' Psilocybin Laws with Religious Exemption Claims

A recent case report on psilocybin for Alzheimer's patients has brought attention to the "complex" legal landscape for psychedelics in Brazil. The treating psychiatrist openly admits to administering psilocybin to hundreds of patients, potentially leveraging his association with a religious group claiming constitutional protections for ceremonial use. This scenario underscores the significant legal ambiguities and varied approaches to psychedelic administration outside formal research, particularly in jurisdictions with evolving or unclear regulations.

We also spoke with Marcos Lago, the São Paulo-based psychiatrist and first author of the case report. The patient was dosed under his supervision at his private practice, where he says he has administered psilocybin to 200 people despite the 'complex' legal context in Brazil. He is also associated with a religious association named Associação Cruz de Ankh, which may offer some Constitutional protections for ceremonial practices, perhaps including the use of psilocybin.
