Current Status
California Governor Newsom signed SB 58 in October 2023, decriminalizing personal possession of psilocybin mushrooms, psilocin, DMT, and mescaline for adults 21+ effective January 1, 2025. Prior to statewide decriminalization, several cities including Oakland, San Francisco, Berkeley, and Santa Cruz had already passed local decriminalization measures. Psilocybin remains illegal to sell or distribute, and no state-regulated therapeutic program has been established.
